GENERAL SALES CONDITIONS

The offer and sale of products on the website www.tinyou.shop and its affiliates are governed by the following general sales conditions. The products purchased on the site are sold by Plants&Nature s.r.l., located at Corso Luigi Manzi, 29, 80074 Casamicciola Terme (NA), VAT number 06333861216, REA number: NA-808575

The sales conditions are deemed known by the Customer at the time of purchase. Therefore, each order implies implicit acceptance. These general conditions may be updated or modified at any time by Plants&Nature s.r.l., which will update the dedicated pages within the website.

CONTRACT OBJECT
The offer and sale of products on the website www.tinyou.shop and its affiliates imply the implementation of a distance contract governed by articles 50 et seq. of Legislative Decree no. 206 of September 6, 2005 (Consumer Code), as well as Legislative Decree no. 70 of April 9, 2003 (so-called E-commerce Law).

ACCEPTANCE OF THE ORDER AND CONCLUSION OF THE SALES CONTRACT
By placing an order, the Customer declares to know and accept these sales conditions and the additional information contained on the site. The contract will be considered concluded, and binding for both parties, only when the Customer is notified of the shipment.

PRODUCTS AND SALES PRICES
All selling prices of products on the site www.tinyou.shop and its affiliates include VAT and any other taxes but not shipping costs, which are indicated separately. They constitute a public offer according to art. 1336 of the Civil Code. It is understood that the image accompanying the presentation of the products may not be perfectly representative of its characteristics but may differ in color, size, and accessories from the figure.

PAYMENT METHODS
At the time of purchase, the Customer can choose to pay via PayPal or Cash on Delivery. For PayPal payments, the customer will be redirected to the PayPal site to make the payment with any accepted credit card or through their PayPal account. PayPal directly manages the data entered on its website to make the payment. Plants&Nature s.r.l. does not collect any data related to the Credit Card used or the access codes to the “PayPal” payment form. This information is collected directly by PayPal’s systems.
In the case of payment by cash on delivery, the customer must pay an additional cost of 5.00 euros (VAT included) for the management of cash on delivery by the express courier. Payment must be made upon delivery, in cash, directly to the courier.

TAX CERTIFICATION AND INVOICE
An invoice for products purchased by private individuals is not issued as these are sales operations not subject to the obligation of tax certification under Article 22 paragraph 1 no. 1 of Presidential Decree 633 of 1972 and Article 2 of Presidential Decree 696 of 1996. All customers receive an order summary that has the same fiscal and legal value as a traditional receipt.

DELIVERY METHODS AND TIMES
Products are shipped by courier, and delivery times vary depending on the destination, the time the order is received, and the availability of the product itself. For available goods, delivery to the courier takes place within 5 working days from the moment the order confirmation is sent to the customer. Unless unforeseen circumstances, delivery times in the national territory will be 5/7 working days.
Upon receipt of the goods, the Customer must verify that the package is perfectly sealed, intact, and undamaged. If the customer is not available at the time of order delivery, the courier will leave a notice. The next day, the courier will make a second attempt. If, even in this case, it is not possible to deliver the order, the Customer must contact the courier as soon as possible to arrange delivery, within a maximum of 2 working days. To facilitate delivery without hindrance, the Customer is required to enter a mobile phone number in the delivery details, which will be communicated to the courier.

SHIPPING COSTS
For the shipment and packaging of the order, a contribution of 5.50€ (plus VAT) is required.

RIGHT OF WITHDRAWAL
In accordance with articles 64 et seq. of Legislative Decree no. 206/05, the Customer has the option to exercise the right of withdrawal, without any penalty and without specifying the reason. To exercise this right, the Customer must send an e-mail to ordini@plantsnature.it within 10 working days of receiving the order, and a registered letter with acknowledgment of receipt to Plants & Nature s.r.l. Corso Luigi Manzi 29, 80074 Casamicciola Terme (NA), both containing their details (Name, Surname, Order number of the original order, phone, product description, IBAN code, and account holder of the bank account where the refund will be made). Plants&Nature s.r.l., to facilitate the return operations, will communicate a return code to the Customer. Once this communication is received from Plants&Nature s.r.l., the Customer must send, at their own expense and with a courier of their choice, the product they intend to return. The returned product must reach Plants&Nature s.r.l. within a maximum of 7 (seven) days from the date of sending the return code. Once the returned product is received, Plants&Nature s.r.l. will proceed, by bank transfer, to the refund of the price paid for the product/products (excluding the contribution for shipping) for which the right of withdrawal has been exercised, within 25 working days following the receipt of the products. The exercise of the right of withdrawal will be ineffective if the returned product is not intact, or if the original packaging is missing, or if essential elements of the product are absent, or if the product is damaged. All risks related to the transport of the returned product are borne by the Customer. The right of withdrawal does not apply to perishable products.

PROVISION AND PROCESSING OF PERSONAL DATA
The Customer’s personal data is collected for the purpose of executing the purchase contract and shipping the orders received. This data is processed electronically in compliance with current laws and may only be shown at the request of the judicial authority or other authorities authorized by law. Personal data will be communicated to subjects delegated to carry out the activities necessary for the execution of the contracted services and disclosed exclusively within the scope of this purpose. The Customer expressly undertakes to provide Plants&Nature s.r.l. with a copy of the identity documents deemed necessary for any checks. Failure to comply with this request authorizes Plants&Nature s.r.l. to immediately terminate the contract for non-compliance. The processing is carried out, also with the aid of electronic means, in compliance with the procedures that Article 11 of Legislative Decree no. 196 of June 30, 2003, places in guarantee of the user and, in general, protecting their rights, fundamental freedoms, and dignity, with particular reference to confidentiality and personal identity. The processing will take place for a period not exceeding that strictly necessary for the fulfillment of the above purposes. Obtaining the deletion of personal data is subject to sending a written communication to Plants&Nature s.r.l. APPLICABLE LAW AND JURISDICTION
The contract between Plants&Nature s.r.l. and the customer is governed by Italian law. For any dispute between the parties regarding this contract, the competent court is the Court of Naples.
